Modern Procreation and Legal Implications: From Bioethics to Biolaw
Abstract: The evolution of medical technology in the field of medically assisted human reproduction should, like all innovation and progress, be viewed with great admiration. In the times we are living in, today’s biotechnologies have become for all infertile couples the only hope of fulfilling their dream of becoming parents. However, global dilemmas about the ethical, legal, social and religious implications of medically assisted human procreation are growing in the absence of specific regulations that combine moral and legal principles. In the present study, we aim to outline some of the key issues in this area with regard to the right to know one’s biological identity, anonymous birth and post-mortem procreation. In the current Romanian legal system, there is no special legislation regulating all the situations that may arise as a result of recourse to medical procreation techniques. Biolaw should become the link between scientific research and society’s legal values.
