Personality Rights – a Legal Institution in Actuality

The rights of the personality have returned to the legal actuality with the new regulation of the Romanian Civil Code, which entered into force in 2011. The significance of the protection of the fundamental values of the human being has gained new dimensions, and the solutions issued by the national courts must also meet the standards of protection established at European level. The main rights of the personality benefit not only from a new legislative optics but also from jurisprudential extensions, generated by the mandatory decisions of the European courts. We have identified, for some of the most important rights of the personality, the modern connotations of the object of protection, as they appear in the judicial practice of recent years. The right to life, the right to physical and mental integrity, have classical alignments, interpreted non-uniform way by national and European courts. There is a new generation of personality rights, which will be consolidated under the enforcement of the European regulations on the fair process and personal data protection segments.
